As the contravention is that of “failing to comply with a no entry sign,” it is important to remember that in order to prove this contravention that the enforcing authority must actually show you passing the sign. It is not sufficient to simply show you in or entering a one way street. You can ask to see the video or photographic evidence.
The no entry signs must be placed on each side of the road unless the road is less than 5 meters wide. It is very rare that a road is less than 5 meters wide. If there is only one sign and the road was not less than 5 metes wide then the contravention is not enforceable
Are the signs the correct size (see diagrams above)
Were there any other signs or road markings that contradict the no entry restriction? For example we have seen on occasion a road signed as no entry but the road markings show it as a 2 way road.
In one case there were bollards along the middle of the road with arrows warning motorists to pass to the left of the bollards even through the road was one way against the arrows.
If there are restrictions at certain times were times stated on the Penalty charge notice (PCN) actually the same as on the signs.
